New EU Regulation on Microplastics: FAQ for Plastics Manufacturers

The regulation introduces a uniform European framework that supports companies in handling plastic granulate safely and with minimal loss throughout the entire supply chain. The aim is to reduce unintentional releases and, at the same time, strengthen process reliability, quality and sustainability.

It applies to all companies that handle certain quantities of plastic granulate, as well as to transport and logistics partners – an approach that ensures clear responsibilities and transparency.

The regulation will enter into force 20 days after its publication in the Official Journal of the EU. The date is yet to be published by the EU.

Most requirements will only apply 24 months after entry into force, giving companies a realistic adjustment period to update processes, training and equipment or to link them to existing QM and environmental management systems.

For maritime transport, some rules will only apply after 36 months, giving logistics companies additional preparation time.

The regulation is aimed at companies that handle at least five tonnes of plastic granulate per year. It therefore focuses on companies with relevant material flows.

The following are particularly affected:

• Manufacturers and processors of plastics and recyclates
• Compounders, masterbatch manufacturers
• Warehousing and transport service providers
• Cleaning facilities for tanks/containers
• Carriers (road, rail, inland waterway and maritime transport)

The approach covers the entire value chain, facilitating a common understanding of safe handling standards.

The focus is on plastic granulate as an industrial raw material – regardless of shape and size. This includes pellets, granulates, powders and flakes. The definition allows for a clear distinction, so that companies know exactly which materials are affected in their operations.

The regulation supplements the existing EU regulation (2023/2055) on synthetic polymer microparticles. Both laws interlock and create a consistent European framework.

In future, companies will have to implement measures that are largely based on established operational practice:

• Risk management plan for each facility, including identification of potential release points and appropriate preventive measures
• Appropriate equipment (e.g. collection systems, cleaning equipment, closed collection containers)
• Trained personnel familiar with prevention, containment and removal procedures
• Documentation of the quantities handled annually and, if available, of releases
• Immediate action in the event of accidental releases

Many companies can build on existing QM, environmental or occupational health and safety systems for this purpose.

The verification and certification requirements are structured in stages:

• Below 1,500 tonnes/year:

Self-declaration every five years – a streamlined solution for small and medium-sized enterprises.

• From 1,500 tonnes/year:

Certification by independent bodies, renewed at intervals of several years.

The intervals vary depending on the size of the company; large companies every three years.

Certification processes are based on existing standards and can therefore be integrated into many businesses.

In future, harmonised requirements based on proven industry standards will apply to transport, especially by ship. These include:

• Robust, leak-proof packaging
• Clear information requirements for shippers
• Secure stowage of containers (e.g. below deck or protected on deck)
• suitable equipment on board

These rules support logistics and industrial companies in ensuring uniform implementation across Europe.

Clear emergency protocols apply in the event of accidental releases: releases must be contained, eliminated and – if the environment or health are affected – reported to the authorities. These requirements can be easily integrated into existing operational processes.
